Data Used Upon Conclusion of a Contract
 
Master Data
Surname and first name, full address, all contact information (e.g., email address, telephone number), information about the type and content of our contractual relationship.
 
Other Personal Data
Other personal data that you or third parties provide to us with your consent or otherwise legitimately during contract initiation, during the contractual relationship (e.g., for the issuance of a guest card), or to fulfill legal obligations: date of birth or age, marital status, gender, occupation, ID data, bank details, signing or representative authority, contract duration, cancellation/cancellation periods, or further information about your person that you have disclosed to us yourself.
 
 
Use of Processors
The protection of your data is important to us. Even if we use a data processor—specifically the company Feratel (Guest Register pursuant to § 19 MeldeV), zadego GmbH – CAPCORN Company Software GmbH (Reservation Software), as well as our tax advisor to fulfill our tax law obligations—we ensure that the data processing takes place within the European Union.
 
 
Registration Data – Mandatory Registration
According to the Austrian Registration Act (Meldegesetz), you are obliged to register with us using the data specified in § 5 and § 10 of the Registration Act. This concerns the following data: name, date of birth, gender, nationality, country of origin, address including postal code, and—for foreign guests—type, number, place of issue, and issuing authority of a travel document, as well as the date of arrival and departure.
 
 
Guest Register
Due to the legal obligation imposed on us pursuant to § 19 of the Registration Act Implementation Regulation (Meldegesetz-Durchführungs-Verordnung), we will maintain this data in a guest register and store it for a duration of 7 (seven) years, unless it is processed longer for other purposes mentioned in this privacy policy. The guest register is managed electronically by us, whereby we forward the data to an IT processor for this purpose. The data is stored locally with this processor. A transfer to a third country does not take place.
 
 
Disclosure of Data
The data categories “arrival” and “departure,” linked with the country of origin, are forwarded to the municipality in which our accommodation facility is located, pursuant to § 6 of the Tourism Statistics Regulation (Tourismus-Statistik-Verordnung). Aggregated data on the total number of overnight stays and the persons obliged to pay the accommodation tax must also be transmitted to the respective tourism association, ZELL AM SEE-KAPRUN TOURISMUS GMBH, to which we belong, and/or to the municipality. This is done on the basis of § 9 of the Tyrolean Accommodation Tax Act (Tiroler Aufenthaltsabgabegesetz).
Legal Basis for Processing
The processing operations according to points 1.1 to 1.3 above are based on Art. 6 para. 1 lit. c GDPR (compliance with a legal obligation).
 
 
Additional Data Transmission to the Tourism Board (TVB) / Municipality
In addition, we forward your postal code and your year of birth (in pseudonymized or anonymized form) to our municipality and our TVB for statistical purposes, enabling the creation and evaluation of origin and age statistics by the tourism association. This forwarding is based on Art. 6 para. 1 lit. e (task carried out in the public interest) and lit. f (overriding legitimate interests) GDPR. You can object to this at any time for reasons arising from your particular situation (Art. 21 para. 1 GDPR).
 
 
Guest Card – General Information
You have the option to make use of a guest card. The guest card grants you discounts and/or services at various companies in the region (e.g., discounted admission fees). The guest card is valid for the duration of your stay with us.
Issuance of the Guest Card
The guest card is issued and distributed by the accommodation provider. Depending on the guest card system used by the TVB and/or the accommodation facility, it is issued either in the form of:
    • an electronically generated guest card,
    • a manually created guest card, or
    • the carbon copy of the registration form (Meldezettel).

Processed Personal Data
For both the electronically generated and the manually created guest card, the following personal data, determined from the registration data (see point 1 above), are processed:
First name, last name, date of birth, duration of stay (arrival/departure), country of origin, and postal code.
If the guest card is issued in the form of the registration form (Meldezettel), it contains the content according to § 5 in conjunction with § 9 of the Registration Act (see point “Registration Data” 1.1 above). In this case, no electronic processing takes place for the purposes of the guest card.
When using the guest card, the following additional personal data are processed: data on the usage cycle of the respective card, service utilization, bookings, transaction logging, billing data, and references to the registration data and the accommodation facility.
This data is required, on the one hand, to establish identity and determine the period of validity of the guest card at the respective service provider, and on the other hand, to enable the billing of discounts between service providers, the TVB, and, if applicable, the accommodation facilities.
Legal Basis for Processing
The processing of data for the purposes of the guest card is based either on your consent (Art. 6 para. 1 lit. a GDPR) or, if the guest card is part of the service provision within the framework of the accommodation contract, for the purposes of contract performance (Art. 6 para. 1 lit. b GDPR).
Consent can be revoked by you at any time verbally to the accommodation provider or in writing to the email address agricola@kaprun.at.

Operation of the Guest Card System
The guest card system is operated by the local tourism association (“TVB”). Furthermore, local accommodation facilities and local companies (“service providers”) are involved. The data processed for the guest card will be deleted after 48 (forty-eight) months.

Recipients of the Data
The local TVB receives the data processed for the purposes of the guest card for billing purposes vis-à-vis the service providers and/or accommodation facilities. The individual service providers that grant discounted services based on the guest card also receive the data, provided you claim the guest card services from these companies.
To take advantage of discounts, you must present the respective guest card on which the data is displayed to the service provider and thus disclose it yourself. The entrepreneur then checks whether it is (still) valid, usually by reading the barcode on the guest card and transmitting the barcode data to our IT processor. In doing so, personal data is also transmitted to the entrepreneur, in particular your identity data (to verify identity and date of birth).
If the guest card is issued in the form of the “Meldezettel” (registration form), the provider checks the validity using the carbon copy of the form.

In principle, we only process data that is strictly necessary for the conclusion or fulfillment of the contract.
